Thank you for choosing Tierney Refrigeration. We take pride in delivering reliable, professional service across Brisbane and surrounding regions. By engaging our services or accepting a quotation, you agree to the following Terms and Conditions.
1. General
These Terms & Conditions (“Terms”) apply to all quotations, invoices, and works carried out by Tierney Refrigeration
No variation to these Terms is binding unless agreed to in writing by Tierney Refrigeration.
By approving a quote, paying a deposit, or allowing us to commence work, you acknowledge and accept these Terms in full.
2. Quotations & Estimates
All quotations are valid for 30 days from the date issued unless otherwise stated.
Quotations are based on the information and site conditions available at the time of inspection. Any change in access, conditions, or equipment may require a revised quotation.
Additional works not included in the original quotation will be charged separately at standard labour and material rates.
Tierney Refrigeration reserves the right to decline work if conditions are unsafe or if additional faults are discovered that require reassessment.
3. Deposits & Payments
A 50% deposit is required upon acceptance of a quote before materials or equipment are ordered.
Remaining balances are payable upon completion of work, unless a separate account arrangement exists.
Account holders must settle invoices within 7 days of the invoice date.
Payments can be made via EFT, credit card, or other agreed methods.
Overdue invoices may incur interest and administrative fees. Failure to pay may result in service suspension or debt recovery action.
4. Call-Outs, Travel & Labour
A minimum call-out fee applies to all service and maintenance work. This covers travel, the first 15 minutes of labour, and administration.
Travel beyond 30 km from Brisbane CBD may attract an additional travel charge.
After-hours, weekend, or public holiday work is charged at time and a half or double-time rates, depending on timing and urgency.
Travel time between multiple sites during the same day may be charged where substantial travel is required or requested.
Parking fees, tolls, and other access-related costs will be added to the invoice where applicable.
5. Variations & Additional Works
Any variation from the agreed scope of work—whether requested by the customer or arising from unforeseen circumstances—will be treated as a variation and charged accordingly.
Tierney Refrigeration will inform the customer of any additional costs prior to proceeding.
Work may be paused if authorisation for variations is not provided.
6. After-Hours, Emergency & Call-Out Services
“After Hours” refers to times outside Monday to Friday 7:00 am – 4:00 pm and all public holidays.
Emergency call-outs for urgent refrigeration or safety issues attract a minimum after-hours call-out fee plus a premium labour rate.
Travel beyond 30 km from Brisbane CBD during after-hours service may incur additional travel charges.
If our technician attends and the issue is not deemed an emergency, after-hours rates will still apply.
Cancellation or rescheduling of an after-hours call-out within 12 hours of the booking may incur the full call-out charge.
7. Parts, Equipment & Warranty
All new parts and equipment supplied by Tierney Refrigeration are covered by manufacturer warranties.
Our workmanship warranty covers installation and repairs for 12 months from completion, provided the system has not been tampered with or serviced by unauthorised personnel.
Warranty does not cover:
Misuse, neglect, or operator error
Electrical supply issues, power surges, or weather events
Equipment not supplied by Tierney Refrigeration
Normal wear and tear or consumables (filters, seals, etc.)
Warranty claims are subject to inspection and approval by Tierney Refrigeration.
All supplied parts remain the property of Tierney Refrigeration until paid in full.
8. System Access & Site Conditions
The customer must provide safe and unobstructed access to all work areas and equipment.
Delays caused by restricted access, unsafe conditions, or locked areas may incur additional charges.
Tierney Refrigeration reserves the right to refuse work if safety standards are not met.
The customer is responsible for ensuring adequate power, lighting, and space are available for our technicians to work safely.
9. Cancellations & Rescheduling
Appointments cancelled with less than 24 hours’ notice may incur a call-out fee.
If our technician arrives and cannot gain access or commence work for reasons outside our control, a minimum call-out fee will still apply.
If work cannot proceed due to unsafe or unsuitable site conditions, we may reschedule or charge for lost time accordingly.
10. Service & Maintenance
Regular maintenance is essential for reliable performance and warranty validity.
Tierney Refrigeration can provide scheduled maintenance agreements upon request.
While we may issue service reminders, responsibility for ongoing maintenance remains with the customer.
Breakdowns due to poor or missed maintenance are not covered under warranty.
11. Digital Approvals, Quote Acceptance & Communication
Acceptance of a quotation via email, electronic signature, “click to accept”, SMS, or app constitutes binding approval of the quote and these Terms.
By approving a quote, you authorise Tierney Refrigeration to commence work and accept full liability under these Terms.
Digital communications (email, SMS, or app messages) relating to scheduling, authorisations, or variations form part of the service contract.
Customers must keep their contact details current and respond to communications promptly to avoid delays or additional costs.
Any changes requested after acceptance of a quote must be authorised in writing (or digitally) and may incur additional charges.
12. Ownership, Title & Repossession Rights
All goods, materials, equipment, and parts supplied by Tierney Refrigeration remain our property until payment is received in full.
Title to goods transfers only once all outstanding amounts (including fees and charges) are fully paid.
Until title transfers, the customer must:
Keep goods in good condition and identifiable as Tierney Refrigeration property.
Not sell, lease, or otherwise dispose of goods without written consent.
In cases of non-payment, insolvency, or breach of these Terms, Tierney Refrigeration reserves the right to:
Enter any premises where goods are located to inspect, recover, or repossess them,
Disconnect or remove unpaid equipment or components, provided it can be done safely and legally.
The customer agrees to provide unrestricted access for such recovery and indemnifies Tierney Refrigeration against any loss or damage resulting from lawful repossession.
Repossession does not release the customer from liability for the full outstanding balance, including any recovery or legal costs.
Tierney Refrigeration reserves the right to assign or engage third parties to recover debts or repossess goods if necessary.
13. Privacy & Data
Tierney Refrigeration respects your privacy and only collects information necessary to provide our services.
Customer data is stored securely and is not shared with third parties except where required by law or to perform warranty registration.
14. Liability & Limitations
Tierney Refrigeration will take all reasonable care in the performance of work but will not be liable for indirect, consequential, or economic loss arising from system failure, downtime, or delays.
Our total liability is limited to the cost of the original work performed.
Tierney Refrigeration is not liable for loss of perishable goods, business interruption, or damage resulting from equipment failure.
Nothing in these Terms limits your rights under Australian Consumer Law.
Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia. Any disputes will be handled under Queensland jurisdiction.
